This chapter is filled with examples of statutes that have been struck down by the courts. A Texas law banning flag burning was rejected by the Supreme Court, as was a Louisiana death penalty statute. The Affordable Healthcare Act has been voided by two lower court judges, and the Supreme Court may or may not agree with the action.
Do you like the fact that courts can void laws that they determine to be in violation of the Constitution? Or is it wrong for appointed judges to overrule “the will of the majority” as expressed by elected members of Congress and state legislatures?
Constitution:
Constitution is the fundamental rules and regulations that a state or country is acknowledged to govern. It is set-up by the government and provides primary rights and freedom of the citizens and state in the democratic country.
Thus, constitution helps us to improve the democracy in the country and smoothen the functioning between state and federal government by solving the dispute among them.
“Mr. X likes the fact that the courts can void laws which they determine to be in violation of the Constitution”
Explanation:
If the new enacted law is violated by the constitution and amendments, then it affects the basic rights of the citizen and fails to smoothen the functions of the government. This ultimately collapses the democracy in the country. Hence, it is liked by Mr. ‘X’ that the law is voided by the court which violates constitution.
