If you sue for $200.00 in the Civil Court, Small Claims Part, tell me what choices you would make and the benefits or detriments(harm) that would result and why?

Solutions

Expert Solution

Few are the options or choices; I need to consider in case of sue, these are as stated below:

  • Over small things, court proceeding could go much costly affair, further; it will take long time to solve the issues. Hence, I need to understand the clear issues and how much money I can recover from such sue case. Is that money more than cost of court proceeding?
  • Suing anyone requires taking help from attorney and I should clearly file the case that will prove further that other person must pay for my damages.
  • Another choice that I can chose here, I can tell other person to pay the small amount like $200 voluntarily for the damage caused. For court filing, that person would be responsible for paying that severance cost plus entire court proceeding cost.
  • I can follow choices like sending letter of demand, building negotiation process, or establishing mediation process or I should have kept insurance that can cover the damage amount.

Now let me share the benefits or detriments (harm) that could be resulted in this case and why:

  • Here, benefits like I can enforce the contract, in case, if I find that any way contract or related law is broken by another person, suing could help me to build respect towards the law and contract.
  • I can recover the damages, however, I should understand the reasons for which I am suing a person that should be correct or appropriate. Otherwise, it may take my cost more and bring no benefits.
  • Court proceeding could be time consuming and it would include more cost. I should take advice that whether I will be getting appropriate amount and that somehow bringing me benefited or not.
  • Some damage could have long future aspect and detrimental effects, I should also consider in a situation that will recover my damage in much effective way.
