An employee of Delta Airlines is burned by spilling airplane fuel while fueling a plane, because safety stops and covers are not installed properly on your fuel lines. As a Delta executive, what legal concerns do you have? What remedies, if any, does the employee have?

You decide that you will start requiring vision tests of your employees, and adopt a policy that you will either not hire or terminate anyone who does not have 20-20 vision uncorrected. This is a legal problem. Is the test a problem? Why? Is the policy a problem? Why?

The legal concerns i have is related to worker's safety and compensation. As Management or executive, It is my company's duty to make sure that workers or employees are working in safe and sound condition. We must make sure that workplace is safe for them. we must have health and safety policy. In this situation, Company has legal action related work safety and compensation.

In this case, Employee has remedy to file for compensation from the company for the damanges. He can file compensation under Workers' compensation law . It is a system of rules in every state designed to pay the expenses of employees who are harmed while performing job-related duties. Employees can recover lost wages, medical expenses, disability payments, and costs associated with rehabilitation and retraining.

Vision test is not a problem because Companies are allowed to have information related to health condition of their employees. This include their visions as well. The policy related to Not hiring or termination is legal issue under The Americans with Disabilities Act (ADA)

The Americans with Disabilities Act (ADA) prohibits discrimination against people with disabilities. In this case,Employer must accommodate those employees who have visual issues but able to correct them like use of contacts or glasses.

If employee fire or not hire employees who are able to correct their visions with glasses and contacts then they will be held liable under ADA act.
