Objective: Learn how financial remedies can assist victims.
The main financial remedy for victims is restitution. This is the recovery of out of pocket expenses the victim suffered. Other remedies include civil litigation, insurance coverage, and victim compensation. These are all areas that victims may recover a portion of their losses depending on the circumstances of the case.
In our daily life we have to face many types of financial loss. In some cases we are able to recover the loss and in some cases we are unable to get any kind of compensation. In case of car accident car damage is a common matter and we all have car insurance. But in all situations the insurance coverage may not be possible. Again, the insurance may offer some little compensation.
The key factors in such situation: The place of occurrence, the situation of the occurrence, the terms and condition of the insurance policy, what type of damage occurred, who are under loss, whether there is third part issue, the police case and so on.
Restitution: The victim needs to apply to the concerned insurance company. At the initial situation, the victim needs to report to the company. Then the victim needs to apply according to the procedure. The investigation is done. Then the value of the compensation depends on the investigation report. In most of the cases it appears that the company tries to deny most of the claims of the party to deprive the victim.
Civil litigation: There may be the issue of the third party. In such case the victim needs to pay to the third party because insurance tries to avoid this. In case of accident, it appears that the victim needs to pay at the spot to the third party for loss. If there is the coverage of the third party, then the company makes so late that all become exhausted.
Legal issue: The legal issue sometimes becomes more lengthy and the victim has to do expense to get compensation. But it is not always good.
Compensation: The insurance company pays to the victim at last and it never pays proper value.
