While Brutus’s arguments predate modern theories of “minimalist,” “pluralist,” “aggregative,” or “deliberative” democracy, he is clearly working from a definition of “rule by the people” that we can compare to contemporary theories of democracy. Which of the four “models” of democracy is Brutus’s definition of democracy most like? Brutus believed the liberties of the American people were best protected by the thirteen states continuing to be confederated republics. In essence, he advocated confederation under a federal head with specific and well-defined purposes instead of the consolidation of power into one federal government. He is a believer of REPUBLIC DEMOCRACY MODEL. He believed that the Constitution and laws of every state would nullified and declared void if they were, or shall be inconsistent with the Constitution. If Congress believed that a state law may prevent the collection of a federal tax that is necessary and proper to provide for the general welfare of the United States, then Congress would have the authority to repeal the law under the necessary and proper clause. Furthermore, because all laws made in pursuance of the Constitution are the supreme law of the land, the states would have no recourse. Therefore, the government is complete, and no longer a confederation of smaller republics. These points from Brutus essay clearly supports REPUBLIC democracyacy.
