Does Title IX apply to all universities, schools and athletic programs? What process should an institution use to determine whether a school is in Title IX complies?
Title IX is applicable to all the educational institutions which are both private and public, which receive a federal fund by the public. All the universities and colleges should abide the Title IX because they recieve a federal funding through many financial aid programs which are being used by the students.
The process for the regulation of Title IX asks the institutions to provide an equal athletic opportunity for both the sexes and to effectively help and accomodate the students' abilities and athletic interests. The 1979 Policy Integrations regarding the Title IX establishes a three tier test which determines whether the institute is meeting all its obligations regarding Title IX. An institution is regarded to follow the the same if it means any one of the following parts of the test mentioned below:
1. The number of females and males is to be proportionate to their respective enrolments.
2. The institution has a regarded history and a sustainable
practice of expanding the participation and opportunities
responsiveness for development of the interest for the
underrepresented sex of their instituition.
3. At last, The institution is effectively and fully accomodating the abilities and the interests for the underrepresented sex of their instituition.
