What is a springing power of attorney?

Solutions

Expert Solution

Sprining power of attorney as the names suggests springs after meeting certain conditions. This type of power of attorney is basically used when the Principal becomes disabled or incompetent. For example a factory worker can create spring power of attorney inorder to make himeself to be prepared for the possibility of having an unfortunate accident in facory which may make the person disabled or incometent to take sound decision. In that case the relative of the workers (in favour of whom this power of attorney has been created) will get power to handle the financial affairs of the Principal. In short this gets activated when the principal gets disabled or mentally incompetent.
