To what extent do the laws regulating contract of sale of goods and hire purchase agreement in Malaysia protect consumers? Explain using your own example/ illustration.
The Sale of Goods Act governs the sale of commodity laws in
Malaysia, New Zealand, the United Kingdom and Canada.
The bill, which has a short title, will be known as a bill for the
sale of goods during the passage of Parliament.
Action for the sale of goods may be the common name for the law of
the short name or for all the laws pertaining to the sale of
goods.
A person can only transfer ownership of the property unless he also
owns it. An honest third party purchase will be weaker than the
original owner’s claim.
The goods must match their description. Otherwise, the seller will
face strict liability. For a business-to-business transaction, this
term cannot be excluded from the contract, but this term may be
included for business-to-business transactions.
The goods must meet a reasonable test for satisfactory quality.
This means that goods must be what people reasonably expect,
considering prices, descriptions, and other circumstances. However,
this right is lost when the defect is first indicated by the seller
or when the buyer has inspected the goods and the defect is
obvious.
The goods must fit their intended purpose. This indicates that the
buyer must inform the seller why he wants to buy the item. If this
purpose is not made clear, the buyer cannot claim any refund.
Similar to the default description condition, the product must
conform to the prototype and installation, unless the seller shows
the difference first. If the seller agrees to perform the
installation or arrange the installation, this must be done
properly.
For example, for a specific product, the property determines when
the product is in the distribution phase. In addition, for
uncertain goods, ownership is transferred until the goods have been
identified and delivered to the buyer. On the other hand, when a
business is sold to a customer, the business is still obligated to
bear the risk of the product until it is delivered and received by
the customer.
