When a professional like doctors, lawyers,accountants etc operate in thier area of expertise then they have duty of care towards thier clients and should act as a reasonable professional so that such liabilities like negligence, malpractices do not arise in thier occupation.

I believe that court take thier decision or approach on the basis how much standard of care they take to provide thier service to thier clients. Professionals are required to be up dated with changes in thier occupation because not keeping up with current changes in thier occupation will raise their liabilities and bring more legal issues to them and organization in which they are working.

for example- Government implemented a new change in accounting practices like new accounting principles and new Tax policies should be conducted from next month. If accountant uses old accounting priciples and tax policy to provide services to their client then client will face loss in his accounting and tax work due to failure of accountant's duty of care and act as reasonable person.

This is applies to doctors to remain updated about standards of health practices and health codes etc while diagnosing and treating or medicating patients.

So,, yes, it is very essential for professionals to know court's approach and remain up to dat with changes in thier occupation to reduce thier liability chances.

note--I can only give you just few ideas for fist question-

I believe it is fairr of the courts to believe that professionals in thier occupation should act as reasonable professionals and provide best expertise with best of thier skills, knowledge and updated information so that they and thier client do not suffer damage. Professionals failed to act a reasonable professional and breach thier duty of care owed to their clients only face civil lawsuits like negligence towards them.
