Richard and Kevin decided to go for ice cream after work on Friday to celebrate Kevin's birthday. Richard purchased the largest cone and Kevin selected his favourite flavour. Kevin took two mouth fulls and out jumped a mouse! He felt sick in his stomach and subsequently suffered severe diarrahea. He is upset and comes to you for advice. Advise him.
The product that is Ice cream that Kevin has consumed has affected his health, and it is a serious concern. It is the case of consumer responsibility. Before buying the Ice cream, should have checked for the Date of Manufacturing of the Product. Kevin has suffered because he consumed expired products, which deteriorated his health very severely.
Also, Kevin can go to the consumer court to file a complaint against the ice cream vendor to keep the expired product and sell it to the consumer without even checking the date of manufacture. The ice-cream vendor has to compensate Kevin for the deterioration of his health. The ice cream failed to perform his duties by giving the right product that is not expired. The court needs to decide whether it is the fault of Kevin, who has not to check the date of manufacture before buying, or it is the fault of the ice cream vendor who has sold the expired product.
