The ice-cream vendor has to compensate Kevin for the deterioration of his health. The ice cream failed to perform his duties by giving the right product that is not expired. The court needs to decide whether it is the fault of Kevin, who has not to check the date of manufacture before buying, or it is the fault of the ice cream vendor who has sold the expired product.
