Tom Long and Mark Short ask their attorney, Susan North, Esq., whether Title VII of the Civil Rights Act applies to The Long and the Short of It ("L&S”). L&S has four stores with a total of 62 employees. Growth has been phenomenal. QUESTIONS: 1. Does Title VII of the Civil Rights Act apply to The Long and Short of It? Why or why not? 2. If it does apply, what is the organization required to do with regard to do with regard to their selection process of potential candidates? 3. If it does apply, what steps should the organization take to avoid being in violation of Title VII of the Civil Rights Act? 4. What should the company do if it receives notice of a claim for discrimination?
1. Since the organisation employs more than 15 workers at its facilities, it comes under purview of Title VII of the Civil Rights Act.
2. The organisation needs to ensure that the selection process complies with Act and no discrimination on the ground of age, sex, race, national origin and color is made while making a hiring decision.
3.. The organisation needs to employ comprehensive guidelines with regard to the hiring, promotions, wages, work conditions, privileges of employment and other terms governing the conditions of employement of the candidates / employees to avoid the incidents of unintentional discrimination on various grounds like sex, race, color,religion and national origin.
4.the company should review the charge notice and respond to the authorities with a position statement. It should respond to the request for additional information from EEOC investigator. It should retain relevant documents, ask EOCC authorities for doubts if any. It should also consider the EOCC mediation for prompt resolution of dispute.
