Discuss the five purposes of sentencing/punishment and how they relate to environmental or industrial crime and to white-collar crime in general.
The five purposes of awarding punishment are- a) For creating a check or obstacle-The law enforcement agencies prevents future crimes by frightening the criminal accused by awarding severe punishment. Many fraud cases which are being manipulated in public & private sectors gets redressal of grievances. It not only applies to the individual who commits & gets punished but also it applies to the public at large because in this way public understands & learns from an individual defendant's punishment , the public is less likely to repeat similar kind of crime in future because of fear of severe punishment the person committed crime experienced. b)To Paralyze or to weaken- It prevents the crime to take place once again by removing the criminal from the society. In this case the criminal is removed or locked up or restrained to do any further crime thus helps the society in a big way. c) Rehabilitation- It prevents environmental crime further by changing the behavioural attributes of the criminal. Examples includes educational & vocational programmes, counseling etc that helps to transform the persons mind thus helps to stop any further industrial or environmental crime to take place. d) Retribution- It prevents crime by removing the desire for vengeance in a form of any assault against the accused. When victim realize that the criminal has been adequately punished for the committed crime then become satisfied that the law enforcing mechinary is working properly thus prevent any further chance of any white-collar crime in future. e) compensation of loss or damage incurred or repayment - It prevents future industrial or white collar crime by punishing the accused financially very badly.When the court orders fine to the accused then the victim regains the faith in law as the victim gets paid for the loss & damage & also for the emotional sufferings he or she has to undergo.
