Explain why the goal of criminal law is not 100% prevention.
A crime is an act or omission that breaks an existing law, is harmful to an individual or society and is punishable by law.
Criminal Law: It prohibits conduct which is perceived as dangerous to people.Criminal law is created through statutes that is laws which are made by legislature.It Authorize punitive or rehabilitative treatment of the offender.
There are Several goals of criminal law which states that goal of criminal law is not 100% prevention:
- The general goal is prevention of undesirable behaviour.Most crimes focus on serious behaviour that is considered to be morally wrong or extremely dangerous.
-To protect society.
*damages the community (eg.drug trafficking).
* harms individual's (eg. Murder )
* causes loss of or damage to property (eg. theft, vandalism )
- DETER future offences
* specific deterrence - discourages the offenders from committing future crimes
* General deterrence - discourages the other members of the community from committing similar crimes.
- PUNISH the offender - this satisfies the need for justice and is intended to ensure that the states ( not individual's) is responsible for maintaining public order and safety.
