Exports and reexports to Cuba are denied according to the general policy but there are exceptions to it like medicines and medical devices, items necessary for environmental pollution, telecommunications, items to meet the needs of the Cuban people but they are reviewed on a case by case basis. There is also in vogue the license exception for the items to be exported to cuba, which include those items that improve the living conditions, which enable travel and commerce and items which help in the free flow of information. License Exception Agricultural Commodities has the authority to allow export of agricultural commodities if they meet the criteria listed in Section 740.18(a) of the EAR. Likewise, export and reexport of definite commodities and software to eligible recipients in Cuba are allowed under the License Exception Consumer Communications Devices. Bureau of Industry and Security if an aircraft flies or a vessel sails to Cuba, even temporarily as it constitutes an export. License Exception Gift Parcels and Humanitarian Donations can allow the donation of medicines, food, medical devices or normal gifts but only to an eligible recipient, which is guided by Section 740.12(a) of the EAR.
Countries that are most restricted destinations for U.S. exports are Crimea Region of Ukraine, Cuba, Iran, North Korea, Syria and Sudan.
