Solution: For any person to have a qualified child they must qualify the relationship test.
Relationship Test: Child must be your Son,Daughter,adopted child,step child,eligible foster child or a descendant of any of them.
There are other tests like age,Residency and joint return test.
Age Test: Since he is a three year old he qualifies age test.
Residency test: Child must have lived in United States for more than half of the year. since the child has lived the whole year in US he qualified Residency Test also.
Joint Return Test: since the details regarding this are not provided I assume him to pass Joint return test.
So he is a qualifying child only for father and his grand mother but not his aunt because the child does not qualify the relationship test with respect to his aunt.
Who can claim EIC if child is qualified child for more than one person?
Only one person can claim EIC for the same child. If the child is a qualifying child for more than one person and one of them is a parent then the non parent can clain EIC for that child only if the non parent AGI(adjusted gross income) is higher than that of parent.
In this case grand mother has the highest AGI than any other. So grand mother of child can claim EIC.
Conclusion: Grandmother of the child can claim EIC.
