should all costs of a civil litigation be borne by litigants? explain.
Civil litigation is the process in which civil matters are resolved in a court of law. Civil matters can be described as situations dealing with relationships between people, such as a marriage, divorce, patent disputes or a contract dispute between corporations. It is a type of non-criminal legal dispute, in which the case is presented at a trial where one party seek some compensation or other damages from the other.
According to me all the costs of a Civil litigation shouldn't be bore by the litigants. This is because civil litigation is also a type of justice seeking process in which one fight for justice against the injustice done to him by the other party. So if the costs of a civil litigation will be bore by the litigants, some of them can't pay because they are poor and hence they can't go to the court for any injustice done to him/her and this will be a violation of their right. Everyone in a country must have the right to seek justice in the court of law and f they have to pay a high cost for it, it will no longer be a right as some of them can't afford. If a person can't fight for his right it will be an inhuman behaviour and every other mighty people will do injustice to the poor.
Yes, there can be a small fee for the civil litigation case and if government or court want to share costs of the civil litigation, they can collect a part of it from the party which is proved to break the law and cause damage to other party.
