In some countries, like the United Arab Emirates, religion plays a strong role in laws governing how people live their daily lives. For example, during the celebration of Ramadan, it is illegal to eat, drink or smoke in public during daylight hours (even in your car!). In the United States, the Establishment Clause of the Constitution is supposed to prevent religion from playing this sort of political role (although it doesn’t always). What reasons might there be for favoring the Establishment Clause? What reasons might there be for opposing it?

Establishment Clause:

In the Constitution law, an amendment was introduced by which a restriction placed on Congress that they can’t make any law to support any religion or to prohibit the exercise of any religion.

This was done to maintain the privacy of religion, freedom of free exercise which is the constitutional right of every citizen.

Reason for favouring Establishment clause:

  • It protects the people’s Religious Liberty
  • No Government interference in your practise of religion
  • National unity is focussed and given importance
  • Importance to belief that all humans are created by one God and therefore free to exercise their religion

Reason for Opposing Establishment clause:

  • Though in a democratic country, majority speaks but here when the constitution barred doing of something, even the majority will have left unheard.
  • Use of word ‘Under God’ were criticized to a great extent because of equalizing it with affirmation to country at one side and to the God at other side at same time
  • Incompetence of the state to decide on religious matters             
  • Inconsistencies in the language of the clause leads to many objections.
