The objective of this training document is describe the major
employment laws, management's responsibilities and employee
remedies in case of discrimination at workplace.
The major employment laws are as follows:
- The Fair Labour Standard Act (FLSA): This law
sets the minimum wages need to pay by the employer to the employee
and also limits the type of duties and hours for the teens to
work.
- The Equal Pay Act (EPA): This law prohibits
the unequal pay for same type of work done by the female employees.
It states that every employee whether a female or a male should be
paid equally for same position and same type of work.
- The Occupational Safety and Health Act (OSHA):
It states an employer should provide a safe environment or place
for their employees at work.
- Title VII of Civil Rights Act: This Act
prohibits the discrimination done at the time of firing, hiring or
pay based on the religion, national origin or sex. It also states
that there should be no sexual harassment at the workplace.
Report Processes:
- ?The reporting procedure will inlcude a complaint that needs to
be filed by the harrsed employee.
- Investigation needs to be done by analyzing the situation and
each and every aspect of that situation.
- An immediate an effective action will be take as a remedial
step to protect the employee from such kind of harassment.
Management's responsibilities will include the
following:
- Management need to pay attention to the complaint and should
address it properly.
- Management should develop a written policy against such kind of
harassment that includes company's equal policy for every
employee.
Employee remedies during harassment:
- An employer after finding the responsible person for harassment
should fire him or her immediately.
- An employee can get the front pay and compensatory damages
